The Service provides a platform that facilitates access to short-term rentals of equipment, goods, and other items, as well as experiences, by connecting users seeking to rent or participate in such offerings (“Customers”) with users, businesses, hosts, or providers offering equipment, goods, or experiences through the Service (“Providers”).

Lendo is a technology platform that facilitates connections between Customers and Providers. Lendo does not generally own, manufacture, operate, or directly provide the User Items or Experiences offered through the Service.

User Items may include, without limitation, cameras, drones, bicycles, electric scooters, gaming consoles, outdoor equipment, musical instruments, and other goods offered through the Service. Experiences may include, without limitation, Nile boat rides, felucca trips, horse tours, sightseeing activities, and other experiences offered by Providers.

The specific details, availability, pricing, conditions, and descriptions of any User Item or Experience are provided by the applicable Provider through the Service.

Any communication or transaction between you and a Provider or Customer, including fees, the quality, safety, legality, condition, availability, or suitability of any User Item or Experience, is subject to the applicable agreement and the information provided through the Service.

Lendo may provide tools, verification processes, payment services, customer support, dispute-management mechanisms, reviews, ratings, and other features intended to improve the experience and trust of users. However, these features do not constitute a guarantee or endorsement of any Provider, User Item, or Experience.

You must be at least 18 years old to use the Service.

By agreeing to these Terms, you represent and warrant that:

1. you are at least 18 years old;
2. you have not previously been suspended or removed from the Service; and
3. your registration and use of the Service comply with all applicable laws and regulations.

If you are an entity, organization, or company, the individual accepting these Terms on your behalf represents and warrants that they have authority to bind that entity to these Terms.

To access most features of the Service, you must register for an account.

When registering, you may be required to provide information such as your name, email address, phone number, identification information, or other contact information. You agree that all information you provide is accurate, complete, and not misleading, and that you will keep it accurate and up to date.

You are solely responsible for maintaining the confidentiality of your account and password and for all activities occurring under your account.

If you believe your account is no longer secure, you must immediately notify Lendo.

Lendo may require identity verification or additional information where reasonably necessary for security, fraud prevention, regulatory compliance, payments, or the proper operation of the Service.

Certain features of the Service require payment.

Before completing a transaction, you will have an opportunity to review the applicable price, fees, taxes, and other charges.

Unless otherwise specified, all applicable fees will be displayed to you before payment.

The Service and all materials provided through it, including software, designs, graphics, trademarks, logos, text, databases, interfaces, information, and other materials (“Materials”), are owned by Lendo or its licensors and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not use, reproduce, modify, distribute, or exploit the Materials without Lendo’s prior written permission.

The Service may contain links, integrations, payment services, maps, communication tools, social-media features, or other services provided by third parties.

Third-party services are not controlled by Lendo, and Lendo is not responsible for their content, availability, security, or practices.

Your use of third-party services may be subject to their own terms and privacy policies.

Lendo respects intellectual property rights and expects users to do the same.

If you believe that content available through the Service infringes your intellectual property rights, you may contact Lendo with sufficient information to identify the allegedly infringing content and the rights involved.

Lendo may remove or restrict access to content that it determines, in its discretion, violates applicable law or these Terms.

Lendo may terminate accounts of users who repeatedly infringe intellectual property rights.

Lendo may modify these Terms from time to time.

Material changes may become effective after reasonable notice to existing users where required by applicable law.

Your continued use of the Service after the effective date of revised Terms constitutes acceptance of those Terms.

If you do not agree with the revised Terms, you should stop using the Service and may terminate your account.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Lendo and its affiliates, directors, officers, employees, contractors, agents, and partners from claims, damages, liabilities, losses, costs, and expenses arising from:

1. your use or misuse of the Service;
2. your violation of these Terms;
3. your violation of applicable law;
4. your violation of third-party rights;
5. your User Content;
6. disputes between you and another user; or
7. damage, loss, or misuse of User Items or Experiences resulting from your conduct.

Lendo may, at its discretion, provide limited protection, reimbursement, or coverage to eligible Providers for certain loss, damage, or theft involving User Items rented through the Service.

Any such protection is subject to separate eligibility requirements, limitations, exclusions, claim procedures, and maximum amounts established by Lendo.

Providers must report qualifying incidents within the applicable reporting period and may be required to provide:

• a detailed description of the incident;
• photographs or other evidence;
• proof of ownership;
• receipts or evidence of repair or replacement costs;
• identification documents; and
• any other information reasonably requested by Lendo.

Coverage may not apply to certain categories of items, including but not limited to:

• motor vehicles;
• real estate;
• consumable or perishable goods;
• illegal goods;
• weapons;
• cosmetic damage;
• normal wear and tear;
• cleaning costs;
• lost income;
• damage occurring outside the applicable rental period; or
• items requiring specific insurance or licensing where such requirements have not been satisfied.

Lendo does not guarantee that any Provider will receive reimbursement or coverage.

The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law.

Lendo does not guarantee that:

• the Service will always be available;
• listings or information provided by users will always be accurate;
• User Items will always be available or in a particular condition;
• Experiences will always meet your expectations;
• users are trustworthy or suitable for a particular transaction;
• the Service will be uninterrupted or error-free; or
• all transactions will be completed successfully.

Lendo is a marketplace and technology platform and is not generally the owner, manufacturer, seller, rental provider, operator, or insurer of User Items or Experiences offered by third parties.

Users are responsible for evaluating the suitability, safety, legality, and condition of User Items and Experiences before using them.

To the fullest extent permitted by applicable law, Lendo and its affiliates, directors, officers, employees, agents, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to:

• your use or inability to use the Service;
• your interaction with another user;
• User Items;
• Experiences;
• transactions between users;
• loss or damage to property;
• personal injury; or
• loss of profits or business opportunities.

To the fullest extent permitted by law, Lendo’s aggregate liability arising from or relating to the Service or these Terms will be limited to the greater of:

1. the amount you paid directly to Lendo during the twelve months preceding the event giving rise to the claim; or
2. an amount determined by applicable law.

Nothing in these Terms excludes liability that cannot legally be excluded or limited under applicable law.

As a Customer, you acknowledge that:

1. you are using an online marketplace;
2. you may interact with individuals or businesses you do not personally know;
3. User Items may involve inherent risks;
4. Experiences may involve physical, environmental, transportation, or other risks;
5. Lendo does not guarantee the conduct, qualifications, reputation, or suitability of every Provider;
6. you are responsible for taking reasonable precautions when interacting with Providers; and
7. you assume the risks associated with using User Items and participating in Experiences, except to the extent such risks cannot legally be waived.

You agree, to the fullest extent permitted by law, to release Lendo and applicable Providers from claims arising from ordinary risks associated with transactions, User Items, or Experiences, except for claims involving gross negligence, willful misconduct, fraud, or liabilities that cannot legally be excluded.

As a Provider, you acknowledge that:

1. providing User Items or Experiences to Customers may involve risks;
2. you are responsible for ensuring that your User Items and Experiences comply with applicable laws and regulations;
3. you are responsible for the accuracy of your listings and descriptions;
4. you are responsible for obtaining any licenses, permits, insurance, or approvals required by law;
5. you are responsible for communicating relevant safety instructions and restrictions to Customers; and
6. you are responsible for your interactions with Customers and for complying with your obligations relating to User Items and Experiences.

You agree to indemnify Lendo for claims arising from your User Items, Experiences, representations, negligence, misconduct, or violation of applicable law, to the fullest extent permitted by law.

Any dispute arising between you and Lendo relating to these Terms or the Service will be resolved in accordance with applicable law and the dispute-resolution procedures specified by Lendo.

Where legally permitted, Lendo may require disputes to be resolved through individual arbitration rather than through class or representative proceedings.

Nothing in this section limits rights or remedies that cannot legally be waived.
